Underdog Participation Release
In consideration for being allowed to participate in any of the programs, events, or activities (collectively, the “Activities”) offered by Underdog Martial Arts, LLC (“Underdog Martial Arts”), I the undersigned, acknowledge, understand, and agree that:
Assumption of Risk
There is an inherent risk of injury associated with participating in the Activities, including, but not limited to, bodily harm, permanent paralysis, and death. Although there are various procedures, equipment, and precautions that Underdog Martial Arts may take to help reduce those risks, I understand that those risks cannot be completely eliminated.
There is an inherent risk of being exposed to illness or disease associated with participating in the Activities, including, but not limited to, exposure to MRSA, staph, impetigo, influenza, and COVID-19. Although there are various procedures, equipment, and precautions that Underdog Martial Arts may take to help reduce those risks, I understand that those risks cannot be completely eliminated.
I knowingly and freely assume all risks associated with my participation in the Activities, both known and unknown, and I assume full responsibility for my participation in the Activities.
Agreement to Follow Instructions
I agree to follow all instructions communicated to me by Underdog Martial Arts or one of its instructors. I understand that if I observe any unusual significant danger related to the Activities, or anyone failing to follow the instructions, I am responsible for immediately removing myself from the dangerous situation and bringing the situation to the attention of an Underdog Martial Arts instructor.
Release and Indemnification
I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release Underdog Martial Arts and each of its instructors (collectively, the “Released Parties”) from any and all claims or causes of action that I may have for any injuries (including death), illnesses, or any other damages that may arise out of, or relate to my participation in, the Activities, even if caused by the negligence of any of the Released Parties, to the fullest extent permitted by law.
I agree to defend, indemnify, and hold the Released Parties harmless from and against any and all claims, liabilities, damages, losses, costs, and expenses (including, without limitation, reasonable attorneys’ fees) caused by or related to my participation in the Activities, including my negligence, willful misconduct, or failure to follow instructions or safety procedures.
Additional Provisions
I consent to treatment in the event of an emergency or other incident related to the Activities in which, in the judgment of the Released Parties or any medical personnel, requires medical attention.
I understand that I may be photographed or recorded while participating in the Activities.
Likeness Release
I hereby grant the Underdog Martial Arts permission to use my likeness in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration.
I understand and agree that all photos will become the property of the Underdog Martial Arts and will not be returned.I hereby irrevocably authorize Underdog Martial Arts to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo.
I irrevocably grant Underdog Martial Arts and its agents the unconditional and perpetual right to use such photographs and recordings in any media throughout the world, without additional review, compensation, or approval from me or any other party.
Communications
I agree to receive promotional e-mails related to classes, promotions, events, and other information related to Underdog Martial Arts. I understand that I can opt out or receiving promotional e-mails at any time, but that I will continue to receive e-mails related to my account.
I HAVE READ THIS RELEASE, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
